The trucks of kryptonite were in Witness a season 2 episode (not a middle of the series season). The tattooed guys were in Kinetic (season 1).
No, it wasn't the truck of kryptonite in Witness, but you have the right idea from my last answer. In this case, though, the something stolen is not alien, which to me includes kryptonite.

I was thinking maybe Hydro -
- Clark in disguise as the Green Arrow;
- Plenty of connivery going on with Clark conniving with Lois to try to set Oliver up to discover whether or not he is the Green Arrow, and then conniving with Oliver to throw Lois off the scent, and Lois conniving with Jimmy to get him in on the whole thing. Lex conniving to get information about Lana and Clark by paying Linda Lake, who was just generally a conniving character. Also Lana and Chloe conniving to spy on Linda with the web-cams.
- Unusual chase might be Tori Spelling going after the steroid-using ball player... Or the fight scene between Chloe and Linda Lake.

The answer to your 1st question is yes.
I don't really understand the 2nd question. By person whose identity was mistaken, do you mean the person wrongfully blamed?

I thought about that too but the problem I had, I guess, was whether or not Maxima "intended" to kill those guys. Was she "attempting" murder?

- Lex thought Lionel would trust only himself with the key, but that wasn't true hence he left the key to Chloe
