We don't actually know if he is dead or not.

It is possible that he was able to take off the Blue K bracelet whilst Brainiac downloaded the information but that will probably be more of a battle for the Producers of Smallville to do. :\

But the other stuff I agree with but when have TPTB ever used common sense to any character on Smallville :rolleyes:

Brainiac was not evil when he was created. He was not created solely by Dax-Ur either. In Lara, Lara talked about "Jor-El's Brainiac" and how he/it had the potential to end the war. So Jor-El also worked on Brainiac. I think Jor-El learned from Dax-Ur. I think Dax-Ur was Jor-El's professor or mentor and developed the main coding or materials that allowed Brainiac's creation to be possible. Then Jor-El learned from him and used that coding & knowledge to build Brainiac.
