Evil janitor?!

Did anyone notice the DP janitor from Lexmas in this episode? Chloe and Clark walk right past him , again while talking about private things. I doubt tptb could think this up, but what if he's not really a janitor? Maybe Lex or lionel has him spying on chloe, or perhaps he's...Brainiac!
